When did 1099-NEC start and last changes

The IRS brought back Form 1099-NEC to separate contractor income from other income types. Here is a short timeline of its changes:

2020: The form returned to active use for reporting nonemployee compensation.

2021; 2022; 2023; 2024: No major structural changes.

2025: Added Box 3 to track excess golden parachute payments.

2026: The form handles specific overtime pay and cash tips. The $600 filing threshold becomes $2,000.

What is a 1099-NEC Form Used For

Entity rules — LLC, S-corp, partnership, corporation, nonprofit

You handle contractors' taxes differently depending on their structure. Standard corporations are typically exempt from this process. The exception is legal fees, which you must report even if the law firm is incorporated.

Other business structures need paperwork. Does an LLC partnership get a 1099-NEC? The answer is yes. Standard partnerships and multi-member LLCs taxed as partnerships must receive a form for their services.

Don't assume a nonprofit is automatically exempt from these filings. If you pay a tax-exempt organization for services, standard reporting rules still apply.


Special payees — attorneys, foreign contractors, rental, childcare

Some specific payment types follow different rules. Understanding these 1099-NEC exceptions helps avoid filing mistakes.

  • Law Firms, Legal Fees: reported on Form 1099-NEC, even if the law firm is incorporated. Attorneys receive gross settlement proceeds on Form 1099 MISC.

  • International Remote Work: You don't always report payments on Form 1099-NEC for foreign contractors. International contractors outside the U.S. may not require Form 1099-NEC if proper documentation like Form W-8BEN is collected.

  • Rent, Childcare: Rent goes only on Form 1099-MISC, while personal childcare payments are not reportable.

1099-NEC Threshold — $600 to $2,000 (OBBBA)

The reporting threshold tells you when a business is required to file tax paperwork. The 1099-NEC threshold for independent contractors is calculated separately for each taxpayer based on the total payments for services received during the calendar year.

For a long time, the IRS 1099-NEC $600 threshold official limit stayed completely the same. According to past IRS instructions, paying any freelancer 600 dollars or more meant you had to issue a form. This rule applied to both the 2024 and the 1099-NEC threshold 2025 tax seasons.

Everything changed with the One Big Beautiful Bill Act 1099-NEC threshold update. This legislation, known as OBBBA, updated the tax code to reduce paperwork for small businesses:

With this law, the 1099-NEC threshold for 2026 is much higher. With a $2000 limit, you'll issue fewer forms this year. Starting in 2027, the government will adjust this number annually based on inflation.

Federal vs. State Rules:

Federal changes don't automatically alter state reporting laws. Some states still enforce a lower minimum requirement, even if you don't meet the new federal limit. Stay safe by checking your contractor's state laws.


How to Fill Out Form 1099-NEC

Before you begin, gather your business details, the total amount paid, and the worker's tax info from their Form W-9. This is easy with 1099-NEC instructions.

Here is how to fill out 1099-NEC for contractor payments:

  1. Enter your business name, address, phone number, and tax ID number.

  2. Input the worker's name, address, and TIN.

  3. For the 2025 tax year, put the total compensation amount in Box 1, and use Box 3 to report excess golden parachute payments.

  4. For the 2026 tax year, refer to the updated IRS instructions for the new box requirements.

  5. Fill in federal or state withholding amounts. This step ensures you satisfy both federal rules and 1099-NEC state filing requirements.

You can choose to handwrite the fields if you use an official, scannable IRS form. However, you cannot print the form and mail it to the IRS because a copy must meet IRS scanning requirements. If you use an online tax service or software, you can print the contractor's copies on paper.

Copy A & the red form (why you can't just print it)

The IRS requires a special red-ink Copy A for paper filing. You can't just get a printable PDF and mail it. The IRS will reject forms that aren't machine-readable.

Form 1096 transmittal

Form 1096 is a paper transmittal form that must accompany your physical mailing to the IRS. It summarizes the total number of submitted documents and income received by recipients.

Paper filing & where to mail it

You can use paper if you have a few forms to provide. But filing on paper means you must include Form 1096 along with Copy A. Then, send both forms to the IRS. Your mailing address depends on where your business is located. Check the official instructions to find out where to mail the 1099-NEC to IRS centers.

Businesses with 10+ forms, however, must file online.


State filing requirements

Always check local 1099-NEC state filing mandates. Some states participate in a combined program where the IRS shares federal data automatically. Other states require filings submitted directly to their own tax departments.

Verify the current rules with your local state tax authority.


Send to contractor / e-delivery

You must mail or digitally send Copy B to your worker by the official deadline. Use electronic delivery only if the contractor gives permission first. Otherwise, mail a physical copy.


1099-NEC Deadline

The 1099-NEC deadline to send to recipient contractors and the IRS is January 31. This timeline applies to both 2025 and 2026. It does not matter whether you e-file or use paper mailing because both methods follow this rule. If January 31 falls on a weekend or holiday, the deadline moves to the next business day. In 2026, January 31 falls on a Saturday, so the deadline is February 2, 2026. Make sure to submit Form 1096 by this date, too.

Unlike Form 1099-MISC, which has additional time for IRS filing, Form 1099-NEC follows one deadline. Always check IRS instructions for the exact date.

You can request a 30-day filing extension using Form 8809, but this only extends the IRS filing deadline. Contractor copies must still be provided on time.


Penalties & Corrections

Late / non-filing penalties

The IRS charges a penalty for not filing if you miss the deadline. The fine increases the longer you wait. Keep in mind that missing one form can trigger two separate fines: one for the IRS and one for the worker. Small businesses have lower maximum annual penalty caps.

Here are the 1099-NEC late filing penalty rates:

  • 1 to 30 days late: $60 per form.

  • 31 days late through August 1: $130 per form.

  • After August 1 or not filed: $340 per form.

  • Intentional disregard: $680 per form with no maximum cap.

Online and timely filing avoids these penalties the best.


How to correct or amend a 1099-NEC

If you discover an error, you must learn how to correct a 1099-NEC. When you submit the correction, remember to use the same filing method you used for the original form.

To amend the incorrect records, follow the steps:

  1. Prepare a new form.

  2. Check the "Corrected" box.

  3. File this updated copy.

  4. Send it to the contractor.

  5. Keep records of both filings.

You can buy official paper forms at office supply stores or order them from the IRS.
