What is a Notice to Quit?
A Notice to Quit (Notice to Pay or Quit/Notice to Pay Rent/Notice to Vacate/Eviction Letter) is a legal notice issued by a landlord to a tenant. Depending on the underlying cause, this document can serve distinct purposes. It’s most often used to tell a tenant to pay overdue rent, fix a violation of a lease agreement (e.g., having pets or overcrowding the premises), or to move out by the indicated date. The purpose of the notice also determines the type of document a landlord must issue. It can be a 3-day notice, a notice to vacate, or another.
This notice is not an actual court order to move out. It’s a warning that requires a tenant to solve the problem that can precede unlawful detainer if a tenant fails to pay or leave the property. It can also be used to solve other violations of the lease agreement.
Although it’s often the first step in the eviction process, a Notice to Quit is not the same as eviction:
Notice to Quit meaning: A formal document (not a court judgment) that acts as an early warning and does not require a tenant to move out immediately, but typically requires an action, such as paying overdue rent.
Eviction meaning: An official court judgment issued if a tenant fails to resolve the contract violation, pay rent, or move out after a notice. In most US states, after receiving it, tenants are required by law to vacate the premises.
Types of Notice to Quit
A Notice to Quit can take several different forms depending on the type of violation and jurisdiction. In the sections below, we’ll look at the most common types and their distinctive features.
3-day Notice to Pay or Quit
A 3-day Notice to Pay or Quit is a formal written warning that rent is past due. It requires a tenant to either pay back the owed amount or leave the property within three days. The three-day window typically starts on the next day after receiving a warning. If a tenant pays on time, the tenancy should continue as normal. If they don’t pay, a landlord can file an eviction lawsuit. However, certain errors, such as an overstated amount, can void a three-day notice and cancel the requirement to vacate the property.
The main states that have a common practice of using 3-day notices are California and Florida.

Notice to Vacate (7–30 days)
A Notice to Vacate is a formal notice that requires a tenant to move out. Unlike a Notice to Pay or Quit, it doesn’t offer a cure period but explicitly asks a tenant to leave the premises.
A Notice to Vacate can give tenants different deadlines to leave the property, depending on the state. 30 days is a standard average timeframe that works in most states. However, some jurisdictions make exceptions.

A Notice to Quit is a legally binding form. An eviction letter is a letter warning from a landlord that doesn’t have the same legally binding nature. The main elements of this letter are:
Legal names of the tenant(s)
The full address of the rental property
Explanation of the reason for eviction
The cure period
The landlord’s contact information
Important: A casually written letter might not be sufficient in states that mandate using precise statutory phrases, code citations, or specific tenant rights warnings. Washington, Nevada, and California require an official framework to demand rent payback from a tenant. These states provide standardized notice forms that must be used instead.
Notice to Pay Rent
A Notice to Pay Rent is another form of a past-due rent notice that landlords can use. It’s used as a soft warning before starting an eviction process and as a tool to encourage tenants to pay their debt. The time provided to vacate premises can vary depending on the state and rental agreement. For example, a 3-day notice to vacate Texas is the minimum notice landlords in this state can provide to tenants unless the lease agreement says otherwise.
